By using our website and/or placing an order for goods you confirm your agreement to our terms and conditions, including the Privacy Policy, as set out below:

Conditions


An order for goods placed by you, the buyer, through our website shall be subject to these terms and conditions.

All other terms and conditions, expressed or implied by statute or otherwise, are excluded to the fullest extent permitted by law.

Nothing in these terms and conditions shall affect the statutory rights of any consumer.

The words ‘you’ and ‘your’ used throughout these terms and conditions refers to the buyer/client.

The words ‘we’, ‘our’ and ‘us’ used throughout these terms and conditions refers to Pink Sherbet Designs Limited, the seller.

Copyright and Confidentiality


All designs and stationery are copyright of Pink Sherbet Designs Limited. All rights are reserved.

Any unauthorised reproduction of designs or products is strictly prohibited. We take any unauthorised copying or printing of our design work very seriously. Legal action will be taken in all such cases. Any designs created for you using our bespoke service will remain copyright of Pink Sherbet Designs Limited

The majority of stationery purchased at from Pink Sherbet Designs Limited incorporate our company branding and will be as discrete as possible. This is for copyright and branding reasons. Any items that are hand-finished with small attachments such as ribbons, bows and gems will be printed with the following warning 'This card is not suitable for children under 36 months due to detachable small parts’. This warning will also be as small and discrete as possible.

Samples


Samples are available for all stationery designs shown on our website. Samples will be supplied to you (the buyer) in the same colour(s) and format as they appear on this website. If you would like to tweak the design or alter colour(s) of your chosen sample(s) please indicate your preferences in the 'Additional Information' section of this form. Please note that there is an additional fee for this bespoke service of £15 for the first bespoke sample - additional bespoke samples are charged at £10 each. If you do indicate that sample alterations are required we will contact you to arrange a quotation and collect further payment. The cost of all samples will be refunded when you place an order with us.

Please note: for our bespoke service (where we create a totally unique design) we are only able to generate designs and provide exact samples/colour requirements once we have received a 50% deposit based on the sum total of your order quotation. This deposit is required as our bespoke service is so completely personalised.

Samples can be ordered by the following means

Physical samples are made available as part of our service to help you decide which range would be best suited to your wedding. Our samples are an indication of print and material quality only and are not personalised (unless you opt for a bespoke sample).

Colours shown in the images displayed on this website and electronic email proofs may vary slightly from the colours of the final printed product. This is because colours on displayed on screen and in print are slightly different. However we try to show all stationery products and colours as accurately as possible. We do advise customers to order samples wherever possible before ordering stationery, as the cost of samples are refunded and this ensures that you are100% happy with the design and colours before you buy.

Orders


All orders for goods shall be deemed to be an offer by you, the buyer, to purchase goods pursuant to these terms and conditions.

Once you (the buyer) have placed your order you will be contacted within 24 hours by telephone or email so that we (the seller) can collect the details required for each item of your stationery order.

Once you have placed an order, paid your 50% deposit in full and supplied us with the required information to feature on your stationery items, you will receive electronic stationery drafts by email within 5 working days.

All text that you (the buyer) would like to feature on your items of stationery must be supplied to us (the seller) in Word, Excel or Email format (this includes guest names). We (the seller) are unable to produce your order if you (the buyer) do not supply us with this information, as and when we request it.

If you (the buyer) fail to supply us (the seller) with the required information to produce your order, Pink Sherbet Designs Limited cannot be held liable for being unable to complete your order.

It is your responsibility to check that your order details are correct before your stationery item(s) go to print.

The checking of proofs is the responsibility of the buyer. We require written confirmation either by signed physical sample accompanied by completed sample approval form or e-mail stating that the proof(s) are correct or that the requested amendments have been made. We will not begin printing your order until you confirmed that all you are happy to proceed to final print. All confirmations will be dated and filed.

The cost of any order placed by the buyer allows for one set of client amendments. Any additional changes after this are charged at £10 per amendment.

As the service we (the seller) provide is so completely personalised there is a minimum order quantity of 20 for save the date cards, invitations, RSVP and thank you cards. We (the seller) may accept smaller orders of these items, but this is at our discretion and will incur an extra charge - please contact us for more information.

Please note there may be small variations in colour between samples, proofs and final products. This is due to the nature of printing at different times. Any variations in colour that may occur will not result in a refund or return. This is at the discretion of Pink Sherbet Designs Limited.

No order submitted by you, the buyer, shall be deemed to be accepted by us unless and until we confirm acceptance of your order by e-mail (where applicable) or by telephone.

We are entitled to refuse any order placed by you and will not be required to provide an explanation.

Bespoke Services


Our bespoke service involves an initial face to face or telephone consultation, during which we will gather as much information about you and your wedding as possible to enable us to design the perfect range of stationery for you. Face to face consultations are charged at £25 per hour, take place on mutual ground and are at the discretion of Pink Sherbet Designs Limited.

Pink Sherbet Designs Limited (the seller) owns the rights to any bespoke design commissioned by the client (the buyer), and has the right to reproduce and add it to our standard range at any time.

If you would like a photographic image of a particular flower to feature on your bespoke range of stationery Pink Sherbet Designs Limited will endeavour to source the perfect image.

If you supply us with your own items e.g. photographs, to aid us in the design of your stationery Pink Sherbet Designs Limited will strive to ensure that your photographs are returned to you as we received them. However, should any loss or damage occur Pink Sherbet Designs Limited cannot be held liable. Any photographs supplied by you (the buyer) to pink Sherbet Designs Limited (the seller) for reproduction and sale will be accepted as full permission to do so. Therefore, you (the buyer) will be responsible for any illegal reproduction undertaken due to incorrect licensing or breach of copyright laws.

Proofs


Proofs are available to all clients and are a means of enabling you to check your chosen product design, wording and layout prior to the final prints. You as our customer are totally responsible for checking your personalised proof(s) ensuring that the details and content are exactly as you want them to appear.

Once you have decided that you are happy with your personalised proof(s) it must be signed and returned to us along with completed sample approval form, as we will not begin our final printing process until we have received your "signed off" proof(s). This can also be done by email in circumstances where rapid turnaround times are required.

Notice of any amendments to your design, wording or layout is required from you in writing and then the proof itself will be altered accordingly.

The quotes that we provide are based on one set of client amends on receipt of your "sign-off" proof(s). Any additional amendments or proofs after this point will incur a charge. The charge is £10 per amendment.

Pink Sherbet Designs Limited will endeavour to ensure a high level of quality in our proofs; however the responsibility of the appearance of final products will lie with you, the buyer, once you have approved the final proof(s).

All text and details will appear in English unless you as our customer state otherwise in writing. You as and when we request it must supply any translations in typed format.

Goods


As a customer of Pink Sherbet Designs Limited you are responsible for gaining permission to use any photographs, hymns, poems or songs that you would like to feature on any of your stationery items. Any photographs, hymns, poems or songs, etc supplied by you (the buyer) to pink Sherbet Designs Limited (the seller) for reproduction and sale will be accepted as full permission to do so. Therefore, you (the buyer) will be responsible for any illegal reproduction undertaken due to incorrect licensing or breach of copyright laws.

As mentioned above all designs are copyright of Pink Sherbet Designs Limited.

All stationery items will be printed on the material we feel best suits the design of the relevant range. You as the buyer do have the opportunity to change this material to suit your requirements by choosing from our list of cards. Please note that all table plans will be printed on silk card. All materials and personalisation must be approved by signature before your goods go to final print.

Pink Sherbet Designs Limited accepts no liability for goods lost in transit. Scheduled delivery dates are given as estimates only. Pink Sherbet Designs Limited will not be held liable for any losses as a result of failure to meet specified delivery dates. If you have not received your order, you must notify us as at your earliest convenience, but no later than 3 days after the expected delivery date.

Prices


All prices displayed on our website, quotes and invoices are non-negotiable.

Prices for our bespoke service will be quoted on an individual basis depending on your requirements as the buyer.

Once you have received a quote from us this quote is fixed and final. We are unable to remove items from your order once the personalisation process has begun. Once you have received an invoice it must be paid in full within 7 days of the invoice date.

Payment terms


All prices listed and quoted by Pink Sherbet Designs Limited are in Great British Pounds Sterling. For orders made outside the United Kingdom prices listed and quoted will exchange to the relevant currency depending on the exchange rate at that particular time.

Payment for orders that are not placed through the website (where payment is required in full upon placing your order) will be required in two stages. The first stage of payment is required before we begin work and this will be a 50% deposit based on the quote we give you. This will cover initial consultation and design work. The second stage of payment (the remaining balance of 50%) will be invoiced upon approval of your personalised final wedding stationery proofs.

No stationery order will be printed and dispatched for delivery until full payment is received and cleared through our bank account. This ensures that ownership is passed to the customer once posted. All products remain the property of Pink Sherbet Designs Limited until full payment is received and cleared.

All items and services remain the property of Pink Sherbet Designs Limited (the seller) until they are paid for in full by you (the buyer).

Delivery (Postage and Packing)


Delivery of samples will be dispatched to you (the buyer) by Royal Mail Recorded Delivery, which will require a signature to provide us (the seller) with proof of receipt.

Delivery of orders will be dispatched to you (the buyer) by a special next day delivery service on behalf of Pink Sherbet Designs Limited, which will require a signature to provide us (the seller) with proof of receipt.

Postage and packing charges are included in the prices of our stationery sets e.g. Pearl, Emerald and Diamond, but for all other orders postage and packing will be charged at £10 per delivery. We charge an addition fee of £10 for the postage and packing of table plans as they are very large items mounted on foam board for ideal display purposes, therefore a lot of time and care goes into protecting and packing each table plan for delivery.

All information given previously about delivery charges apply only to orders placed within the United Kingdom. For large orders the delivery cost may increase due to parcel weight. For delivery to over seas countries please contact us and we will be able to quote you a delivery cost.

Pink Sherbet Designs Limited strives to meet all delivery deadlines. However, all agreed delivery dates are approximate and Pink Sherbet Designs Limited cannot be held responsible or accountable as a result of failure to deliver on any set date or dates.

Pink Sherbet Designs Limited is not liable for any consequential loss.

Return of goods


You, the buyer, will inspect the goods as soon after delivery as is reasonably practicable and will notify us of any shortages, defects in the goods or any other complaint in respect of them within 3 days of receiving the goods.

We are confident that you will be happy with the stationery that we provide for you, however, in the unlikely event of any errors occurring on the part of Pink Sherbet Designs Limited, these will be rectified at our cost. Please contact us within 3 days of receipt of goods, in order that action can be taken. We will ask that any stationery in question be returned to us accompanied by a letter detailing any faults or damage (postage will be reimbursed to the customer once it has been established that the fault lies with Pink Sherbet Designs Limited). Stationery will be replaced or rectified as required based on an individual case basis and all settlements will only be made with replacement stationery.

SAVE IN RESPECT OF ANY SHORTGAGES OR DEFECTS IF YOU, THE BUYER, FAIL TO COMPLY WITH THIS CLAUSE WE WILL NOT BE HELD LEGALLY LIABLE IN RESPECT OF ANY OTHER COMPLAINT WHICH SHOULD HAVE BEEN BROUGHT TO OUR ATTENTION WITHIN THIS PERIOD.

Your Warranty


You, the buyer, warrant that all details provided on the order form and any signed quotation provided for the purpose of purchasing the goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds and/or sufficient unused limit available to cover the cost of the goods.

Limitation of Liability


We use all reasonable endeavours to carry out our obligations within a reasonable period of time but will not be liable to you, the buyer, for any loss, costs or expenses arising directly or indirectly from any delays in doing so and we will not be deemed to be in breach of this Agreement by reason of any delay in performing, or any failure to perform, any of our obligations in relation to this Agreement, if the delay or failure was due to any cause beyond our reasonable control. Without prejudice to the generality of the foregoing, the following will be regarded as causes beyond our reasonable control:

Act of God, explosion, flood, tempest, fire or accident; War or threat of war, sabotage, civil disturbance or requisition; Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority; Import or export regulations or embargoes; Strikes, lock outs or other industrial actions or trade disputes; Difficulties in obtaining raw materials, labour, fuel, parts or machinery; Power failure or breakdown in machinery.

If we are prevented from carrying out our obligations in the above circumstances, we will notify you in writing. If we are still prevented from carrying out our obligations 3 weeks from the date such notice was sent, then either party may give written notice to the other cancelling the Agreement. If the Agreement is cancelled in this way we accept no liability to compensate you for any loss or damage caused by failure to perform.

Except where you, the buyer, are dealing as consumer (as defined in the Unfair Contract Terms Act 1977 section 12) we do not give any warranty, guarantee or indemnity as to quality, fitness for purpose or otherwise of the goods.

Except in respect of death or personal injury caused by our negligence, we will not be liable to you, the buyer, for any loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims, which arise out of or in connection with the supply of goods other than as a result of a breach of an obligation arising under the Sale of Goods Act 1979 (as amended) and the Supply of Goods and Services Act 1973.

Website


We will attempt to ensure that the information available on the website at any time is accurate. However, we will not be held liable for any errors or omissions. We will use all reasonable endeavours to correct errors and omissions as quickly as practicable after becoming aware or being notified of these.

All drawings, images, descriptive matter and specifications of the goods on the website are for the sole purpose of giving an approximate description of the goods.

We may also change, suspend, or discontinue any aspect of the website, including prices, terms and conditions, availability of any features, information, database or content or restrict access to parts or all of the website without notice or liability.

Any price increase will not affect any confirmed orders.

English law will apply to this Agreement, and the parties agree to submit to the non-exclusive jurisdiction of the English courts.

The headings in this Agreement are for convenience only and will not affect their interpretation.

We use the information you as the buyer provide us to take payment for any goods/ services you have ordered. Pink Sherbet Designs Limited may also use the details you provide us for marketing purposes to make you aware of new products, services and special offers available.

If we have a query in relation to your order it is normal for us to make contact with you via telephone or e-mail.

We will only pass your details on to third parties for possible marketing purposes; however, we will only do so if we have your approval.

Pink Sherbet Designs Limited will not disclose your payment details to any third party. We are committed to maintaining the security of your payment information.
